This Biometric Privacy Notice explains how HAPPYGLOBAL, LLC (“Company”, “we”, “our”, “us”) collects, uses, stores, and protects biometric data in compliance with applicable laws, including:

* **Illinois Biometric Information Privacy Act (BIPA)**
* **Texas Capture or Use of Biometric Identifier Act (CUBI)**
* **Washington State Biometric Privacy Law**
* **GDPR Art. 9** for users in the European Union/EEA and UK

## **2. What Is Biometric Data**

Biometric data includes:

* **Biometric identifiers:** unique facial geometry, measurements, and facial landmark points.
* **Biometric information:** data derived from biometric identifiers used to identify or verify an individual.

We process biometric data solely for:

* **Virtual Try-On Generation** – mapping clothing to facial and body features.
* **AI Model Improvement** – with explicit consent only.
* **Quality Assurance** – ensuring accuracy of generated results.

## **4. Legal Basis for Processing**

* **GDPR:** Explicit consent under Art. 9(2)(a).
* **US State Laws:** Written or electronic consent as required by BIPA, CUBI, and Washington law.

We will only collect and process biometric data after obtaining your informed consent:

* Consent is obtained via checkbox in the upload interface or during account creation.

## **6. Retention & Deletion**

* Biometric data is retained only as long as necessary for the stated purposes.
* Maximum retention: **3 years** from last interaction or until consent withdrawal, whichever comes first.
* Upon withdrawal of consent, biometric data is deleted within **30 days**.
* Anonymized, non-identifiable data may be retained for analytics or research.

We apply strict safeguards to biometric data, including:

* AES-256 encryption at rest and TLS 1.3 in transit.
* Role-based access controls with MFA.
* Physical security for all data centers.
* Regular security audits and penetration tests.

Biometric data may only be disclosed:
